1. Business details and application of these Terms and Conditions

These Terms and Conditions apply to services ordered through the website, by e-mail, telephone, social media or in another agreed manner.

Before entering into an agreement, the Client is given the opportunity to read these Terms and Conditions and save them on a durable medium, for example as a PDF. The scope, price, duration and other details of a specific service are stated in the current offer or in an individual confirmation.

2. Scope of services and professional boundaries

Perspektywna offers:

  • individual online coaching, personal development and mentoring sessions;

  • coaching and mentoring packages and longer support programmes;

  • support during major life changes and transitions, including finding calm, organising thoughts and identifying one’s own direction;

  • additional practical assistance for Polish people living in the Netherlands, including help with correspondence, CVs and cover letters, preparation for interviews, job searches and understanding straightforward forms.

Coaching and mentoring are personal development services. They are not psychotherapy, medical diagnosis or treatment and do not replace the assistance of a doctor, psychologist, psychotherapist, lawyer, tax adviser, licensed immigration adviser or another qualified professional.

Practical assistance does not include certified translations or a guarantee of the legal or official correctness of documents. The Client is responsible for reviewing and approving the final version of a document before signing or submitting it.

Perspektywna may refuse a service if it falls outside its professional competence, is contrary to the law or cannot be performed safely and responsibly.

3. Booking, agreement, price and payment

An agreement is concluded when:

  • the Client makes a booking and the required payment through the website;

  • the Client accepts an individual offer and Perspektywna confirms the booking; or

  • the parties clearly agree on the service, price and appointment in another manner.

The Client should receive these Terms and Conditions before entering into the agreement. For bookings made outside the website, acceptance of these Terms and Conditions may be confirmed by e-mail or message.

The price presented to the Client before the agreement is concluded applies. Unless agreed otherwise, payment is made in advance, before the service begins. If payment is not received, Perspektywna may suspend the service or release the reserved appointment.

Perspektywna participates in the Dutch Small Businesses Scheme, the KOR. As long as the KOR applies, no VAT is charged on the services. No VAT amount is stated on the invoice, and the application of the KOR is mentioned.

4. Sessions and packages

Sessions take place online using an agreed communication platform. Appointment times are stated in the time zone applicable in the Netherlands, unless agreed otherwise.

The Client is responsible for having a suitable device, a stable internet connection and a quiet and safe place for the session. If the Client is late, the session may be shortened and end at the originally scheduled time.

Sessions are not recorded without the prior and express consent of both parties.

The number of sessions, price and validity period of a package are stated in the offer or purchase confirmation. Unless stated otherwise, a package must be used within six months of purchase. A package is personal and may not be transferred to another person without the consent of Perspektywna.

If Perspektywna needs to reschedule a session, a new appointment will be offered. If a suitable new appointment cannot be agreed, the Client will receive a refund for the part of the service that has not been provided.

5. Rescheduling or cancelling a session

This section applies outside the statutory withdrawal period described in section 6.

The Client may reschedule a particular session once free of charge by notifying Perspektywna at least 48 hours before the agreed appointment. The new appointment must be agreed jointly and take place within the validity period of the purchased service or package.

If the Client:

  • requests a change less than 48 hours before the session;

  • does not attend the session;

  • is more than 15 minutes late without prior contact; or

  • cannot participate for a reason attributable to the Client,

the session may be considered used and the full price may be non-refundable. This is due to the time being reserved and the limited possibility of offering the appointment to another Client at short notice.

If, after the statutory withdrawal period, the Client wishes to terminate the entire agreement or an unused package, Perspektywna will settle:

  • services already provided;

  • sessions cancelled too late or not attended;

  • reasonable and explainable costs connected with preparation and reserved appointment times.

Any remaining amount that must be refunded under applicable law will be returned to the Client. Cancellation costs will not exceed the remaining price of the agreement.

In exceptional circumstances, Perspektywna may voluntarily offer a different solution. Such a decision is made individually and does not create an automatic entitlement for the future.

6. Statutory right of withdrawal for agreements concluded online

A Consumer who concludes an agreement through the internet, by telephone or electronic message generally has the right to withdraw from the agreement without giving a reason within 14 days of the date on which the agreement was concluded.

The withdrawal may be submitted using the function available on the website or by sending an unambiguous statement to info@lifesupportcoaching.nl. Perspektywna also provides separate information and a model withdrawal form.

If the Client wants the service to begin before the end of the 14-day withdrawal period, the Client must expressly request this. If the Client subsequently withdraws from the agreement, the Client pays for the part of the service performed before the withdrawal.

If the service has been fully performed within the 14-day period, the right of withdrawal ends only when the Client has previously:

  • expressly requested that the service begin before the end of this period; and

  • confirmed their understanding that the right of withdrawal will be lost once the service has been fully performed.

In the event of a valid withdrawal, the amount due to the Client will be refunded within 14 days.

7. Responsibility, confidentiality and complaints

The Client makes their own decisions and is responsible for their actions. Perspektywna provides support, asks questions and helps the Client organise the situation and identify possible steps, but does not make decisions on behalf of the Client.

Coaching and mentoring are provided on a best-efforts basis and do not guarantee a specific outcome. The absence of an expected personal, professional or life outcome does not in itself mean that the service was performed incorrectly.

Perspektywna treats information shared during the cooperation as confidential. Exceptions apply where disclosure is required by law, the Client has consented to it or disclosure is necessary in a situation involving an immediate threat to life or health. The processing of personal data is described in the separate Privacy Policy.

Perspektywna is responsible for culpable failure to perform or improper performance of the service to the extent required by applicable law. Perspektywna is not responsible for the Client’s independent decisions, the actions of third parties or outcomes dependent on authorities, employers or other institutions. These Terms and Conditions do not restrict liability or Consumer rights where such a restriction would be unlawful.

Complaints may be submitted to info@lifesupportcoaching.nl and should describe the service, the problem and the requested solution. Perspektywna will respond within a reasonable period, normally no later than within 14 days.

8. Copyright, applicable law and amendments

Texts, graphics, offer materials, exercises and other materials created by Perspektywna are protected by copyright. The Client may use the materials received only for their own non-commercial purposes. Publishing, selling, copying or sharing them with other persons requires the prior consent of Perspektywna.

Agreements are governed by Dutch law. The choice of Dutch law does not deprive a Consumer of protection provided by the mandatory laws of the country in which the Consumer habitually resides.

The parties will first attempt to resolve any dispute amicably. If this is not possible, the matter will be considered by the court with jurisdiction under applicable law.

Amendments to these Terms and Conditions apply to future agreements and do not automatically change the conditions of a service or package purchased earlier. If one provision is found to be invalid, the remaining provisions will remain in force.
